These terms apply when you use truetarps.com or buy from us. "TrueTarps", "we" and "us" mean MKZ Distributors, doing business as TrueTarps, 6510 Rohan Rd, Richmond, TX 77469. By using the site or placing an order, you agree to these terms.

1. Who can order

You must be at least 18 and able to make a binding agreement. You're responsible for giving us correct contact, billing and shipping information.

2. Orders

When you place an order, you're offering to buy. We accept your order when we ship it. We may refuse or cancel an order, for example because of a pricing mistake, suspected fraud, or an item being out of stock. If we cancel, we refund everything you paid. We may limit quantities per order, including during storms or emergencies.

3. Prices

Prices are in U.S. dollars and can change at any time, but the price at checkout is the price you pay. If a price or product detail is wrong because of an obvious mistake, we'll contact you to fix it or cancel and refund the order. We will not raise prices during a declared disaster.

4. Payment

We accept the payment methods shown at checkout. Payments are processed by Shopify Payments and its partners. We never see or store your full card number. Sales tax is added where required by law.

5. Shipping, returns, warranty and privacy

Our Shipping Policy, Return and Refund Policy, Limited Warranty and Privacy Policy are part of these terms.

6. Product information

We work hard to describe our tarps accurately. Sizes are listed as the finished size of the tarp. Small variations can happen, and colors on your screen may look different from the real product.

7. Using tarps safely

Tarps are covers. Unless a product page says otherwise, they are not made or rated for lifting, towing, holding weight, fall protection or fire resistance. Tie a tarp down at enough points, because a loose tarp in the wind can tear and hurt people or property. Don't climb on a roof in bad weather or without proper safety gear. When covering a truck or trailer load, you're responsible for following load-securing laws.

8. Business (trade) accounts

Trade pricing, payment terms and tax-exempt status are only for approved business accounts and may be covered by a separate agreement. Tax-exempt buyers must give us a valid Texas resale or exemption certificate before ordering.

9. Warranty and liability limits

The only written warranty we give is our Limited Warranty. To the fullest extent the law allows:

apart from that warranty, products are sold "as is" without other warranties, and we disclaim implied warranties of merchantability and fitness for a particular purpose,
our total liability for any claim is limited to the amount you paid for the product involved, and
we're not liable for indirect, incidental or consequential damages.

Nothing in these terms limits rights you have under law that can't be waived.

10. Reviews and messages

If you post a review or send us content, it must be honest and lawful, and you give us permission to show it on our site and in our marketing. We don't edit reviews to change their meaning.

11. Using the site

Don't misuse the site: no hacking, scraping, fake orders, or anything unlawful. Site content, photos and the TrueTarps name belong to us or our licensors.

12. Disputes and governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts in Fort Bend County, Texas, and either side may use small-claims court if the claim qualifies. Please contact us first.
